This privacy statement forms part of our Terms & Conditions.

Information Collection & Use

DataWarden will only share your information with outside parties in ways that are described in this privacy statement or if we are required to do so by law or in the good-faith belief that such action is necessary in order to conform to the edicts of the law, co-operate with law enforcement agencies, or comply with a legal process served on our Web site.

Explicit Permission

Is given by you to pass information related to payment to WorldPay, our Payment providers & if you participate in our Encrypted CD/DVD backup set service, our delivery/postal agents. They are obliged to use this information only for the intended purpose; to collect payment or deliver your Encrypted CD/DVD backup set.

When you join

We collect information from you such as your name, address & e-mail address. This information is used to create & then operate your backup & website account. If you later upgrade from a trial account to a full account, it is also used for payment card verification & invoicing. Personal information you provide is not shared with, rented or sold to third parties.

Contact us

You can contact us directly by sending questions or comments on the contact form, (if you are not a full account holder), or through customer service if you are a full account holder. We reply promptly & informatively to your questions. We read all feedback and use it to improve DataWarden for our customers.

Log Files

DataWarden logs IP addresses & browser types or system types for systems administration purposes. Periodically, they are analysed to help us improve the way in which we present website information or deliver your backup service to you.

For site security purposes & to ensure that DataWarden operates as it should we use software programs to monitor network traffic to identify unauthorized attempts to upload, change information, or otherwise cause damage to DataWarden.

We use website statistics, which may involve a 3rd party cookie. They help us to plan future maintenance or upgrade paths and assess information value to our customers. They let us see which pages are popular or unpopular, the visits we have & the page hits we get. We do not share this information & do not collect personally identifiable information within this process.

Cookies

DataWarden uses session cookies; they do not contain personal information. The cookies help us provide you the right information for your DataWarden account. They terminate when you log out & close the browser window at the end of your session.

Third party cookies are used by WorldPay during payment.

Links

DataWarden contains links to external websites. Links to other websites are provided in good faith, but DataWarden cannot be responsible for the privacy or other practices of such sites. You should take care & read the privacy statements of all websites you visit & especially when you provide personally identifiable information. This privacy statement applies only to information collected by DataWarden.

Internal Security

The customer's right to privacy is essential. We do all we can to make sure your information is protected. Access to your account details is monitored & restricted. The backup servers operate in a secure environment. Internal access to the servers is monitored & restricted to authorised people only.

Site & Service Updates

We may send, via e-mail, customers service announcements about site, system & service updates. Customers cannot unsubscribe from these.

Should we add a newsletter or similar in the future we will not send this to you uninvited. You will be able to request it & you can unsubscribe from it.

Correction/Updating Personal Information

If your details change you can update them on your website account in your backup profile.

Notification of Changes

If we change our privacy policy we will highlight it on the main website. If the change involves how we use your details you can choose to keep your existing Privacy Policy. This right only applies to the privacy policy section of the Terms & conditions & does not apply if the new privacy policy were to enhance your privacy protection.
